Terms of Use
As a community member ("User") of or participating organization ("Organization") on TheChange.com website, a service of Ethico Solutions Inc. (Ethico), you are agreeing to be bound by the following terms and conditions ("Terms of Use").
Basic Terms
- You must be 13 years or older to use this site.
- You are responsible for any activity that occurs under your account.
- You are responsible for keeping your password secure.
- You must follow the Community Guidelines and not abuse, harass, threaten, impersonate or intimidate other users.
- You must only use TheChange.com service for noncommercial, personal purposes. All commercial use must be pre-approved and are bound by additional terms of their commercial relationship with Ethico ("Service Agreement").
- You are solely responsible for your conduct and any data, text, information, graphics, photos, profiles, audio and video clips, links ("Content") that you submit, post, and display on TheChange.com service.
- You must not modify, adapt or hack TheChange.com or modify another website so as to falsely imply that it is associated with TheChange.com. Without limiting the foregoing, you may not attempt to gain unauthorized access to any portion of the Site or any other systems or networks connected to the Site by hacking or any other illegitimate means.
- You must not create or submit unwanted email to any of Ethico's members ("Spam").
- You must not transmit any worms or viruses or any code of a destructive nature.
- You must not use Ethico to violate any laws in your jurisdiction (including but not limited to copyright laws), or illegal or unauthorized purposes. International users agree to comply with all local laws regarding online conduct and acceptable content.
Violation of any of these agreements will result in the termination of your account on TheChange.com. While TheChange.com prohibits such conduct and content on its site, you understand and agree that Ethico cannot be responsible for the Content posted on its website and you nonetheless may be exposed to such materials and that you use TheChange.com's service at your own risk.
General Terms
- We reserve the right to modify or terminate the TheChange.com service for any reason, without notice at any time
- We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via email. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgment. Your continued use of the Site following the notification of any changes to the Terms of Use constitutes acceptance of those changes.
- We reserve the right, in accordance with any applicable laws, to refuse service to anyone for any reason at any time.
- We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
- We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content. TheChange is not liable in anyway for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content.
- We reserve the right to, at anytime; reclaim profile or usernames on behalf of businesses or individuals that hold legal claim or trademark on those names.
- You agree to receive TheChange.com newsletter and updates. You can, at anytime, unsubscribe from the newsletter.
Sharing Content
Ethico's service hosts Content, which may be posted on outside websites (excludes logos and other trademarked or copyrighted material owned by a participating Organization or Ethico). However, pages on other websites, which display data hosted on TheChange.com, must either provide a link back to TheChange.com under the Creative Commons Attribution-Noncommercial-Share Alike 3.0 License or for commercial use contact us regarding a content partnership at partners@thechange.com.
Third Party Sites
The Website may contain links to third party websites that are not owned or controlled by Ethico. In the event you leave the Website you are encouraged to review the privacy policies and terms of service of each other website you visit. Ethico assumes no responsibility for the content, privacy policies or practices of any third party websites.
Copyright Infringement
Ethico undertakes to obey all relevant copyright laws. We will review all claims of copyright infringement received and remove content deemed to have been posted or distributed in violation of any such laws. To make a claim, please provide us with the following:
- A physical or electronic signature of the copyright owner or the person authorized to act on its behalf;
- A description of the copyrighted work claimed to have been infringed;
- A description of the infringing material and information reasonably sufficient to permit Ethico to locate the material;
- Your contact information, including your address, telephone number, and email;
- A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner.

Governing Law and Jurisdiction
These Terms of Use will be governed by, and construed in accordance with, the laws of British Columbia and the laws of Canada applicable in British Columbia, which shall be deemed to be the proper law of this Agreement. Any dispute arising from, connected with, or relating to this Agreement or your employment will be resolved by the courts of British Columbia sitting in the City of Vancouver, and the parties hereby irrevocably submit and attorn to the original and exclusive jurisdiction of the courts of British Columbia sitting in the City of Vancouver for those purposes.
Indemnification
You agree to defend, indemnify, and hold harmless Ethico and its affiliates and their respective employees, contractors, officers and directors from all liabilities, claims and expenses, including attorney's fees, that arise from your use or misuse of the Site. Ethico reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Ethico in asserting any available defenses.
Privacy Policy
Your Privacy Matters to Us
This Privacy Policy describes TheChange's policies and procedures on the collection, use and disclosure of your information. TheChange receives your information through our websites, services and third-parties ("Services"). When using any of our Services you consent to the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this Privacy Policy.

Information Collection and Use
Registration: When you create an account on TheChange, you provide some personal information, such as your name, password, and email address. Some of this information, for example, your name, is listed publicly on our Services, including on your profile page and in search results. The majority of our Services are public and do not require registration.
Additional Information: You may provide us with additional information to make public, such as a short biography, your sustainability interests/professional affiliations, your location, contact information or a picture. We may use your contact information to send you information about our Services or to market to you. If you decide at anytime that you no longer wish to receive such information or communications from us, please follow the unsubscribe instructions provided in any of the communications sent to you.
User Activity: Our Services are primarily designed to help you engage with organizations. Your activity (comments, status updates, likes, follows etc.) is public and should be treated accordingly. You should be careful about all information that will be made public by TheChange.
Log Data: Our servers automatically record information ("Log Data") created by your use of the Services. Log Data may include information such as your IP address, browser type, or the domain from which you are visiting, the pages you visit, and the search terms you use. This information is used to analyze overall trends to help us improve the Services.
Cookies: Like most websites, TheChange uses “cookie” technology to collect additional website usage data and to improve our Services, but we do not require cookies for many parts of our Services such as looking at content lists, profiles, or filtering. A cookie is a small data file that is transferred to your computer's hard disk. TheChange may use both session cookies and persistent cookies to better understand how you interact with our Services, to monitor aggregate usage by our users and web traffic routing on our Services, and to improve our Services. Most Internet browsers automatically accept cookies. Information Sharing and Disclosure
Service Providers: We engage certain trusted third parties to perform functions and provide services to us, including, without limitation, analytics, hosting and maintenance, database storage and management, and direct marketing campaigns. You will have the opportunity to opt out of any such transfer if the new entity's planned processing of your information differs materially from that set forth in this Privacy Policy.
Other Information: We may share or disclose your non-private, aggregated or otherwise non-personal information.
Modifying Your Personal Information
If you are a registered user of our Services, we provide you with tools to access or modify the personal information you provided to us and associated with your account. You can also close your account. If you close your account, we will remove your name and other personally identifiable information from our publically viewable data. To request that we close your account and remove your information from TheChange, please send a request to hello@thechange.com. Please send your request using an email account and name that is registered with TheChange. You will receive a response within 7 days of our receiving it.
Our Policy Towards Children
The Site is not directed to persons under 13. If you become aware that your child has provided us with personal information without your consent, please contact us at privacy@thechange.com. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will delete such information from our files.
Changes to this Policy
We may revise this Privacy Policy from time to time. The most current version of the policy will govern our use of your information and will always be at http://www.thechange.com/privacy/. If we make a change to this policy that, in our sole discretion, is material, we will notify you via e-mail to the email associated with your account. If you continue to access or use the Services after notice of changes have been sent to you or published on our site, you agree to be bound by the revised Privacy Policy.
